These Terms of Service (hereinafter referred to as 'these Terms') set forth the conditions for use of the services provided by DynaCamperDX Corporation (hereinafter referred to as 'the Company') on this website (hereinafter referred to as 'the Service'). All registered users (hereinafter referred to as 'Users') shall use the Service in accordance with these Terms.
By using this Service, you are deemed to have agreed to these Terms.
Article 1 (Application)
These Terms shall apply to all relationships between Users and the Company regarding the use of this Service.
Article 2 (User Registration)
For this Service, registration applicants must agree to these Terms and apply for user registration according to the method determined by the Company, and user registration shall be completed when the Company approves this. The Company may not approve applications for user registration if it determines that the applicant falls under any of the following reasons, and shall not be obligated to disclose any reasons for such decisions.
- When false information is provided in the application for user registration
- When the application is from someone who has previously violated these Terms
- When the Company determines that user registration is not appropriate for other reasons
Article 3 (Management of User ID and Password)
Users shall properly manage their User ID and password for this Service at their own responsibility. Users may not transfer, lend, or share their User ID and password with third parties under any circumstances.
Article 4 (Prohibited Activities)
When using this Service, Users shall not engage in the following activities:
- Acts that violate laws or public order and morals
- Acts related to criminal activities
- Acts that destroy or interfere with the servers or networks of the Company, other Users of this Service, or third parties
- Acts that may interfere with the operation of the Company's services
- Acts of collecting or accumulating personal information about other Users
- Acts of unauthorized access or attempts thereof
- Acts of impersonating other Users
- Acts of providing benefits directly or indirectly to antisocial forces in connection with the Company's services
- Other acts that the Company deems inappropriate
Article 5 (Suspension of Service Provision, etc.)
The Company may suspend or interrupt the provision of all or part of this Service without prior notice to Users if it determines that any of the following reasons exist:
- When performing maintenance, inspection, or updates of computer systems related to this Service
- When provision of this Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
- When computers or communication lines are stopped due to accidents
- When the Company determines that provision of this Service is difficult for other reasons
The Company shall not be liable for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of this Service.
Article 6 (Copyright)
Users may only use this Service to post or upload content for which they hold the necessary intellectual property rights such as copyright, or for which they have obtained permission from the necessary rights holders. All copyrights and other intellectual property rights related to this Service and all information related to this Service belong to the Company or rights holders who have licensed their use to the Company. Users may not reproduce, transfer, lend, translate, modify, repost, publicly transmit (including enabling transmission), transmit, distribute, publish, or use commercially without permission.
Article 7 (Disclaimer)
The Company makes no warranty, express or implied, that this Service is free from factual or legal defects (including defects related to safety, reliability, accuracy, completeness, effectiveness, fitness for specific purposes, security, as well as errors, bugs, rights infringement, etc.). The Company shall not be liable for any damages caused to Users by this Service. However, even in cases specified in the preceding paragraph, the Company shall not be liable for any special damages arising from the Company's negligence (excluding gross negligence) resulting in non-performance of obligations or illegal acts causing damages to Users (including cases where the Company or Users foresaw or could have foreseen the occurrence of damages).
Article 8 (Changes to Service Content, etc.)
The Company may change the content of this Service or discontinue the provision of this Service without notice to Users, and shall not be liable for any damages caused to Users as a result.
Article 9 (Changes to Terms of Service)
The Company may change these Terms at any time without notice to Users when it deems necessary. Furthermore, if a User begins using this Service after changes to these Terms, such User shall be deemed to have agreed to the changed Terms.
Article 10 (Handling of Personal Information)
The Company shall handle personal information obtained through the use of this Service appropriately in accordance with the Company's 'Privacy Policy'.
Article 11 (Notifications and Communications)
Notifications and communications between Users and the Company shall be conducted according to the method determined by the Company. Unless Users submit change notifications according to the method separately determined by the Company, the Company shall consider the currently registered contact information as valid and send notifications or communications to such contact information, which shall be deemed to have reached Users at the time of transmission.
Article 12 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their position under the service contract or rights and obligations under these Terms to third parties, or use them as collateral, without prior written consent from the Company.
Article 13 (Governing Law and Jurisdiction)
Japanese law shall be the governing law for the interpretation of these Terms. In case of disputes arising in connection with this Service, the court having jurisdiction over the Company's head office location shall have exclusive agreed jurisdiction.
